1. Experiences-specific Terms
If you are using the Service for an Experience, then these additional terms apply:
1.1 Accommodation Agreements.
After Traveler's application for an Experience has been accepted by the Host, the Host and Traveler will enter into an agreement setting forth the terms and conditions for the Accommodation ("Accommodation Agreement"), which will not conflict with anything contained in these Terms or any guidelines. Worldpackers will not be a third-party beneficiary to any Accommodation Agreement, and will not be responsible for any disputes arising out of such Accommodation Agreement.
1.2 Payments to Hosts.
Hosts may set prices for each Experience that a Host Posts to the Service. When a Host accepts a Traveler's application for an Experience, Traveler will pay Worldpackers all fees stated in the Experience within the time periods specified by the Host. After receiving payment from Traveler for the Experience, Worldpackers will remit such amounts to the Host within 30 days.
1.3 Changes and Cancellations.
Hosts and Travelers are responsible for any changes to the Accommodation that they make through the Service. Except as set forth in these Terms, we are not responsible for confirmations or cancellations of any Accommodation.
1.3.1 Cancellation by Travelers.
Travelers may cancel a confirmed Accommodation at any time by informing the Host on the Service. If a Traveler cancels an Accommodation less than 7 days before the date specified in the Experience, the Traveler will automatically get a 1-star rating.
1.3.2 Cancellation by Hosts.
Hosts may also cancel an Experience at any time, but (i) a notice that Host cancelled an Accommodation will be publicly stated on the Host's profile; (ii) Host may forfeit the eligibility to become a top Host on the Service for a period of 6 months from the date of the most recent cancellation; and (iii) if there are 3 or more cancellation within 30 days prior to start date within a year, we may deactivate Host's account. In case of extenuating circumstances, such as natural disasters, endemic diseases, serious damage to accommodation or changes in the visa or passport requirements of the country, Host may contact us to review the trip cancellation record in Host's account.
1.3.3 Cancellation by Worldpackers.
In certain circumstances, we may decide, in our sole discretion, that it is necessary to cancel an Accommodation and make appropriate arrangements to notify both Hosts and Travelers as soon as possible. This may occur (i) when Worldpackers believes in good faith, taking into account the legitimate interests of both parties, that it is necessary to avoid significant losses to Worldpackers, other users, third parties, or property, or (ii) for any of the reasons set forth in these Terms.
1.3.4 Effect of Cancellation.
If a Host cancels a Traveler's Accommodation within 30 days prior to the start date, we will use reasonable efforts to help Traveler find a different Host within the travel period shown on the trip confirmation, but cannot guarantee that a replacement Accommodation will be available. If there is no availability in the current destination, Worldpackers reserves the right to find Hosts in alternative cities or positions that differ from the position described in the Experience. Worldpackers is not responsible nor covers the transportation costs or other similar costs if there is a need to change the destination city during the relocation process.
